Many thanks to Deborah Ross of the NC Chapter of the ACLU for a 'heads-up' to
the NCTC office on this unique opportunity for progress in the following
advocacy effort -
Representative Bob Hensley from Wake County - a long-time friend and
supporter of the arts - is apparently helping to sponsor a bill (House Bill
#493) that increases the penatly for indecent exposure in the state of North
Carolina. The current text of the bill follows at the end of this email.
How does this affect us in the theatre community? Well, many of you in the
field have experienced first hand the potential of current statutes on
nudity, indecent exposure, and others, being used to hinder or halt the work
you do in theatre (based on the content of important plays that have been
produced in this state). Rep. Hensley's bill in its current form increases
the penalty that can be utilized.
Does Representative Henley mean to the hinder such work in the theatre and
the performing arts? Not likely - the word is that he is simply trying to
help local municipalities deal with public urination on city streets, and
such instances.
THE OPPORTUNITY HERE IS ...
We can possibly make a positive impact by contacting Representative Henley to
do the following (by EARLY Tuesday morning, March 13th) -
1. Thank Rep. Hensley for his long-time support of the arts in this state.
2. Ask him to refrain from having House Bill # 493 in its current form heard
in committee on Tuesday, March 13th - and to hold it out for further review,
due to the potential impact it will continue to have on performing arts
organizations in the state.
3. Ask him to consider amending House Bill #493 to make an exception for the
type of performing arts/fine arts events that we produce - in order to
exclude performing arts organizations from the penalty and from being covered
in the statute.

confusion, frustration, and fear for many performing arts organizations in
this state that has occurred for many years given current statutes.

Short Title: Increase Penalty for Indecent Exposure. (Public)

A BILL TO BE ENTITLED
AN ACT TO INCREASE THE CRIMINAL PENALTY FOR INDECENT EXPOSURE.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 14-190.9(a) reads as rewritten:
"(a)Any person who shall willfully expose the private parts
of his or her person in any public place and in the presence of
any other person or persons, of the opposite sex, or aids or
abets in any such act, or who procures another to perform such
act; or any person, who as owner, manager, lessee, director,
promoter or agent, or in any other capacity knowingly hires,
leases or permits the land, building, or premises of which he is
owner, lessee or tenant, or over which he has control, to be
used for purposes of any such act, shall be guilty of a
Class 2 Class 1 misdemeanor."
SECTION 2. This act becomes effective December
1, 2001, and applies to offenses on or after that date.
